Terms of Service.

1. Introduction

Welcome to the Vouchifyer platform (“we,” “us,” “our”). By accessing and using our website and services (the “Platform”), you agree to be bound by these Terms of Service and Privacy Policy. These policies are designed to outline your rights and responsibilities when using our services.

We provide a platform that enables Customers (hereafter “Customers”) to generate and distribute vouchers, and for individuals (hereafter “ Final Users”) to redeem those vouchers at participating merchants or businesses.

By accessing, using, or redeeming any vouchers through our Platform, you acknowledge and agree to comply with these terms. If you do not agree to any part of these Terms or Privacy Policy, you must discontinue using our services.

2. Definitions

  • Customer: A business or entity that creates, manages, and distributes vouchers through the Platform.
  • User: An individual who redeems vouchers created by the Customer.
  • Platform: The online service provided by Vouchifyer that facilitates the creation and redemption of vouchers.

3. Privacy Policy

This Privacy Policy explains how we collect, use, store, and protect your personal data when you interact with our Platform.

4. Scope and Service

We provide the customer with a platform on which they can create and manage vouchers. The customer pays an annual or monthly subscription fee for using the platform and our service. We act solely as a platform provider and do not engage in any commercial transactions between the customer and the user. We enable the customer to create, manage, and distribute vouchers via the platform. Users can download or copy these and redeem them at the respective business. We assumes no responsibility for the redemption

Subject to your compliance with these terms, we grant you a non-exclusive, non-transferable, revocable permission to:

  • Access the service
  • Download, print and use the QR codes

5. Your Obligations

By using the website, the Customer represent and warrant:

  • All registration information provided is and will remain true, accurate, current, and complete at all times.
  • Will keep your registration information accurate and update it as needed.
  • Responsibility of the own account information, especially the password created to log in the account.
  • Not use the services for any unlawful or unauthorized purposes.
  • Use of the service will comply with all applicable laws and regulations.

If any information the customer provided is untrue, inaccurate, outdated, or incomplete, we reserve the right to suspend or terminate the account and deny any current or future use of the service.

6. Our Rights

We have the right, without provision of notice to:

  • Block the customers account temporarily or completely for any or no reason, including, without limitation, any violation of these Terms of Service.
  • Make the vouchers null and void in the event of late payment or payment default by the customer.
  • Block the IP address of a user for any or no reason, including, without limitation, any violation of these Terms of Service.

7. Registration

Using certain parts of the platform requires registration from the customer. By completing the registration process, the registered user enter into a contract for platform usage. The provider reserves the right to reject applications without stating a reason. We also reserve the right to remove, reclaim, or modify any username the registered user choose if, at our sole discretion, we determine that it is inappropriate, obscene, or otherwise objectionable.

8. Terms of Service

These Terms of Service apply to both Customers using the Platform to generate vouchers and Users redeeming those vouchers.

A. Voucher Creation and Redemption

  • For Customers: You may create vouchers on the Platform to be redeemed by Users. Vouchers are provided free of charge upto 3 active vouchers (maximum of 100 QR codes each) and thereafter a paid version, which shall entitle the Customer for unlimited vouchers.
  • You shall be responsible for ensuring the accuracy and validity of the vouchers you create.
  • For Users: You may redeem vouchers through the Platform. Vouchers can be used in accordance with the terms specified by the Customer (the business offering the voucher). If you wish to receive the voucher in a QR code format, it will be delivered to your email. The customers subscription will continue and renew automatically unless they cancel it. By subscribing, they agree to have a payment method charged on a recurring basis without needing the approval for each renewal, until they cancel the order. The billing cycle is monthly or annually. The customer can cancel the subscription at any time by logging into their account. The cancellation will take effect at the end of the current paid term.
  • Permitted Use: By using this website and the service offered, the Customer agrees to fulfill the following conditions.
    • Comply with the terms of this Agreement at all times
    • Have the capacity to enter into a binding legal obligation under applicable law

B. Voucher Terms

  • Validity Period: Each voucher may/may not have an expiration date, if an expiration date is set it is your responsibility to use it before it expires.
  • Limitations: Vouchers may come with specific restrictions, such as exclusions on certain products or services, minimum purchase requirements, or geographic limitations.
  • No Transferability: Vouchers are non-transferable, cannot be resold, or converted into cash unless stated otherwise.
  • No Guarantee of Redemption: We make no guarantee that a voucher will be accepted by the business or merchant. If the voucher is expired, altered, or otherwise does not meet the terms specified, it may be refused. Vouchers can be redeemed either directly through us or at the designated acceptor’s location. To redeem a voucher, you may need to present it, and in some cases, additional identification may be required. Vouchers are non-transferable and can only be used by the individual who downloaded them unless stated otherwise. Each voucher may be redeemed only once per person and transaction, unless explicitly specified.
  • Prohibited Activities: You are only permitted to access or use the service for its intended purpose. You agree not to:
    • Use artificial intelligence, non-human bots, or similar programs to spam the website or cause damage to the system.
    • Misrepresent your identity, impersonate any individual or organization, falsely claim or mislead others about your affiliation with any person or entity related to the site, or suggest that we endorse any of your statements.
    • Send unsolicited or unauthorized emails on behalf of Vouchifyer, including promotional or advertising content for any products or services.
    • Restrict or prevent other users from accessing the site (e.g., by hacking or altering any part of the site).
    • Copy, duplicate, reproduce, sell, or exploit any part of the site for commercial or personal use.
    • Without limitation, you undertake not to use or permit anyone else to use the Services or Site.
  • Third-Party websites and content: We are not accountable for the content, accuracy, or views expressed on external websites, nor do we monitor, review, or verify their accuracy or completeness. Please be aware that once you click a link on our service that leads to another website, our Terms of Service no longer apply. Your actions, browsing, and interactions on any external site, including those linked from our platform, are governed by that site's own terms and policies. These third parties may also collect information about you using their own cookies or other tracking methods. You understand and agree that Vouchifyer is not liable for any Third-Party Services, including their accuracy, completeness, timeliness, legality, or quality. Vouchifyer accepts no responsibility or liability for any Third-Party Services, whether to you or anyone else. Links to Third-Party Services are provided solely for your convenience, and you use them entirely at your own risk and in accordance with the terms of service set by those third parties.

9. Other Terms Binding

  • Liability Disclaimer: We are not responsible for any loss, damage, or dissatisfaction arising from the use or redemption of vouchers. This includes issues with the Customer (the business issuing the voucher) or third parties involved in the redemption process.
  • Platform Liability: As a Platform provider, we do not guarantee the availability, validity, or successful redemption of any vouchers. All responsibility for the products or services associated with the vouchers lies with the Customer who issued the voucher. Further, we do not guarantee continuous availability of the platform and are only responsible for damages resulting from gross negligence or intentional misconduct. The customer agrees to indemnify the provider against any third-party claims arising from the use of the platform or vouchers created by the customer. We are not responsible for the redemption, acceptance, validity, or legal compliance of the vouchers. Vouchifyer make no guarantees regarding whether the vouchers will be used, accepted, valid, or compliant with any applicable laws or regulations.
  • Indemnification: To the fullest extent allowed by law, you agree to protect, compensate, and release Vouchifyer, along with its directors, officers, employees, agents, service providers, contractors, licensors, successors, and assigns, from any claims, liabilities, damages, legal judgments, losses, costs, expenses, or fees (including reasonable attorney fees) that result from or are connected to your violation of these Terms of Service or your use of the website. This includes, but is not limited to, third-party websites and content, as well as any unauthorized use of the website’s content and services. You waive any claims against the company, its directors, officers, employees, agents, service providers, contractors, licensors, and successors, and agree to hold them harmless from any liability arising from actions taken by the company or any of these parties in connection with investigations conducted by the company or law enforcement authorities.
  • Modifications and Updates: We may, at our discretion, update or modify these Terms and Privacy Policy at any time. Changes will be posted on our website, and it is your responsibility to check for updates regularly. Continued use of the Platform after updates constitutes acceptance of the new terms.
  • Governing Law: These Terms shall be governed by the laws of UAE, and any disputes will be handled exclusively in the courts located within UAE. If any part of these Terms of Service is found to be unlawful or unenforceable under applicable law, that provision will be modified as necessary to closely reflect its original intent while remaining legally valid. The rest of the Terms of Service will remain fully effective and enforceable.
